1. Agreement

These Terms of Use govern your purchase of a My Local Photos Home License and your download, installation, and use of the My Local Photos software (the “Software”) and this website. By buying a license or downloading or using the Software, you agree to these terms. If you do not agree, do not buy, download, or use the Software.

2. Who may use the Software

A Home License is for personal, non-commercial use within a single household. It must be bought by an individual (a natural person), who may let members of their household use the photo library served by the licensed installation. Companies, organizations, institutions, government bodies, and other legal entities may not buy or use a Home License, and individuals may not use the Software on their behalf.

3. License, payment, and refunds

After you pay the one-time Home License fee (currently US$25), and subject to these terms, we grant you a perpetual, personal, non-exclusive, non-transferable, non-sublicensable license to install and use the Software on one home photo server at a time that you own or control, solely for personal, non-commercial household use. If you replace your server, you may deactivate the old installation and activate your license key on the new one. No subscription is required to keep using your licensed installation.

Home Licenses are sold through our reseller, Lemon Squeezy, which acts as merchant of record: it processes your payment, issues your receipt, handles applicable sales tax or VAT, and issues and manages your license key. Lemon Squeezy's own terms also apply to your purchase.

Refunds: you can ask for a full refund within 7 days of purchase. A refunded license key is deactivated. This does not limit any rights you have under consumer law.

Price changes apply only to future purchases. Updates we release are included with your license, but we do not promise to release updates for any particular period, and supported hardware and platforms may change.

4. Restrictions

You may not:

Use the Software for any commercial purpose, including in a business or profession, to provide services to others, or in any activity that generates revenue.
Sell, rent, lease, sublicense, or redistribute the Software, or offer it as a hosted or managed service.
Share your license key, or activate it on more installations than your license allows.
Remove or alter copyright or license notices, or circumvent technical limitations.
Reverse engineer, decompile, or disassemble the Software, except where applicable law expressly allows it.
Use the Software to break the law or to infringe the rights of others, including privacy and data-protection rights.

5. Your photos and face recognition

You keep all rights to your photos and data; we claim no ownership of them. You are responsible for having the right to process the photos you catalog. If you use face detection or label people other than yourself, you are responsible for respecting their privacy and complying with applicable laws, including obtaining consent where required.

6. Ownership

The Software is licensed, not sold. We and our licensors keep all rights, title, and interest in the Software, including all intellectual-property rights. All rights not expressly granted to you are reserved.

7. No warranty

To the extent permitted by law, the Software is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms affects the statutory rights you have as a consumer. You are responsible for keeping independent backups of your original photos.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, photos, profits, or goodwill, arising from your use of or inability to use the Software. Nothing in these terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.

9. Termination

Your license is perpetual, but it ends automatically if you breach these terms. When it ends, you must stop using the Software and delete all copies. Sections 5 to 10 continue to apply after termination.

10. Changes and contact

We may update these terms. The updated version applies to later purchases and downloads, and the date at the top shows the latest version. Changes will not take away the right to keep using a Home License you have already paid for. Commercial or organizational licenses are not currently offered. Questions: [email protected].
